TERMS AND CONDITIONS OF SARINAH PRODUCTS PURCHASE ON SUKHA MENU OF LIVIN’ APPLICATION

Terms and Conditions of Sarinah Products Purchase on Sukha Menu of Livin’ Application (hereinafter referred to as “Terms and Conditions”) set out the procedure for purchasing Sarinah Products, compiled based on the terms and conditions of Sarinah.

 

GENERAL TERMS

  • Livin’ application is mobile banking application of Livin’ by Mandiri, owned and operated by Bank.
  • Bank is PT Bank Mandiri (Persero) Tbk.
  • Sarinah is PT Sarinah, is a provider partner of Sarinah Products which cooperates with Bank.
  • Users are every customer of Bank who accesses and/or makes purchase on Sarinah Products through Sukha menu.
  • Sarinah products are products provided by Sarinah that can be purchased by users directly through Sukha menu.
 

TERMS OF SERVICE

  • Sarinah offers various of Sarinah products that can be purchased by Users through Sukha menu. By making Sarinah Products purchase, Users are deemed to have read, understood, and agreed all contents in these Terms and Conditions as well as the terms and conditions set out directly by Sarinah. Details of the terms and conditions set out directly by Sarinah can be accessed by Users through the link https://sukha.sarinah.com/terms-and-conditions (“Terms and Conditions of Sarinah”).
  • Provision of Sarinah Products through Sukha menu is a cooperation between Sarinah and Bank. Users understand and acknowledge that:
    • The Purchase of Sarinah Products made by Users is a binding legal and contractual relationship between Users and Sarinah. In this case, Bank only acts as a partner displaying purchase menu of Sarinah Products (“Sarinah Platform”) and facilitates the process of Sarinah Products purchase payments.
    • Data and information related to the purchase of Sarinah Products contained on Sukha menu are the data and information received by Bank from Sarinah, and Bank may publish such data and information wisely.
  • By purchasing Sarinah Products, Users agree not to:
    • Copy any information including the services available therein for any purpose other than the purpose of purchasing Sarinah Products; and/or
    • Download, reproduce, or display any available products, information or services for any purpose other than the purpose of purchasing Sarinah Products.
 

PURCHASE & PAYMENT

  • In purchasing Sarinah Products, Users are required to fill in Users data completely and correctly. In the event that there is an error in data entry that harms Users, then this is the full responsibility of Users.
  • All Users’ data submitted in the Sarinah Products purchase process will be documented and used by Sarinah in accordance with the applicable terms. Further details of Sarinah's privacy policy can be accessed by Users through link https://sukha.sarinah.com/terms-and-conditions.
  • In purchasing Sarinah Products, cost will be debited from Users' account contained in the Livin' Application, so Users are obliged to ensure that the balance in the account is sufficient.
  • Users will receive a confirmation of their purchase of Sarinah Products through SMS after Users’ payment has been successfully verified.
  • Sarinah's products shall be delivered in accordance with the terms of delivery time from Sarinah.
  • Sarinah products stock availability is subject to change at any time. In the event that the stock of Sarinah Products is empty, Sarinah through Bank is entitled to refuse and/or cancel the purchase.
 

COST & PROMOTION

  • The price for each Sarinah Product is the price stipulated by Sarinah and is subject to change at any time. Sarinah through Bank only serves Sarinah Products purchase transactions in Rupiah currency.
  • Cost may vary per transaction depending on the number of Sarinah Products purchased with details which Users can see before making payment.
  • Sarinah may offer lower prices and/or promotions from time to time in accordance with the terms and conditions that apply in Sarinah. Please note that this may require different terms and conditions.
  • If there is a promotion provided by Sarinah directly, then the rights and authorities for the promotion rest entirely on Sarinah’s part and may not apply to orders made through Sukha menu.
 

CHANGE & CANCELLATION

  • Users can only cancel purchases, exchange products, and/or refund payments based on, and if they have complied with the Sarinah Return Policy which can be accessed by Users through the link https://sukha.sarinah.com/terms-and-conditions/.
  • Regarding requests for cancellation, product exchange, and/or payment refunds, Users can contact Sarinah directly through the chat feature available on the Sarinah Platform or through email sarinah-care@sarinahportal.com or to WhatsApp +6282124644349.
 

USERS REPRESENTATIONS & WARRANTIES

  • Users hereby release Sarinah and/or Bank from all claims, demands, and/or other legal actions in any forms for the delay and/or failure of Sarinah and/or Bank in fulfilling their obligations related to the purchase of Sarinah Products in the event that such delay and/or failure are due to events or causes beyond the control or capability of Sarinah and/or Bank, including but not limited to natural disasters, fires, wars, riots, sabotages, system disturbances, electricity disturbances, telecommunications disturbances, and/or government policies so that Sarinah and/or Bank are not responsible to or bear Users' losses.
  • Users agree to release and indemnify Sarinah and/or Bank against any claims or demands filed and losses incurred by Sarinah and/or Bank or other third parties in any forms, either directly or indirectly, related to or in connection with the breach of the representations, warranties, and/or provisions in these Terms and Conditions and/or non-performance of an obligation in these Terms and Conditions by Users, including but not limited to claims or demands arising in connection with the cancellation of the purchase of Sarinah Products.
  • Sarinah and/or Bank make no any representations, guarantees, or warranties including warranties of satisfactory quality, fitness for a purpose, accuracy, reliability, and malware free, email phishing, in connection with the purchase of Sarinah Products through Sukha menu.
  • The representations and warranties set forth in this section are in addition to the representations and warranties provided by Users as contained in the Livin' Application Terms and Conditions. Nothing in this section reduces and/or limits the validity of the representations and warranties provided by Users in the Livin' Application Terms and Conditions.
 

LAIN-LAIN

  • Sarinah through Bank is entitled to change the Terms and Conditions and such changes will be effective with notification from Bank in accordance with the applicable provisions. Users are required to carefully read any such changes periodically so that if Users continue to access and/or make Sarinah Products purchase, Users shall be deemed to have known, understood, and agreed to such changes.
  • Other matters concerning application and transaction aspects including but not limited to instructions provided by Users on the Livin' Application is subject to the Livin' Application’s Terms and Conditions.

All issues that arise related to products/services originating from Sarinah shall be resolved by Users with Sarinah.
