Terms and Conditions of Card Dongle

To access and/or use the payment acceptance services using Card Dongle on Livin’ Merchant Application, Merchant hereby is subject to and agrees to be bound by Terms and Conditions of Card Dongle (“Terms and Conditions”), which are an integral and inseparable part of Terms and Conditions of Use for the Livin’ Merchant Application.
 

A. DEFINITION

  • Livin’ Merchant Application, hereinafter referred to as the Application, is an application owned by the Bank that may facilitate a Merchant to carry out its business activities as specified in the Terms and Conditions of Use for the Application.
  • Bank is PT Bank Mandiri (Persero) Tbk which is domiciled and headquartered in Jakarta, which is the owner of the Application and has the authority to process Transactions.
  • Card Dongle is a Card payment acceptance tool which is connected to the Application.
  • Card is credit card and/or debit card.
  • Merchant is an individual or business entity who carries out the Product sale activities both online and offline and has been approved by the Bank as a working partner and is entitled to receive transaction payments based on the method determined by the Bank.
  • Merchant Discount Rate (MDR) is a percentage or specific value of each Transaction charged to the Merchant based on applicable provisions and/or Bank policies, which will be deducted when the Transaction is disbursed to the Account.
  • Account is a Bank account under the name of a Merchant which is used for the account in purpose of disbursing funds resulting from Transactions.
  • Buyer is a individuals who conduct Transactions for the purchase of Products provided by Merchants.
  • Transactions are a payment using Card through Card Dongle for the Products contained on the Application
  

B. General Definition

  • About Card Dongle
    • Card Dongle is a tool/device which is connected to Application to receive the Card payments.
    • Card Dongle adds a payment method for Buyer and improves a Merchant Transaction acceptance.
  • Benefit and Feature of Card Dongle
    • Payments using Card Dongle can be made by dipping or tapping a Card into the device.
    • Type of Card which may be used to make payments through a Card Dongle is a Card with the following type:
      1) VISA;
      2) MasterCard;
      3) GPN; and/or
      4) Other types of Cards determined by the Bank.
 

C. Terms of Use of Card Dongle

  • Card Dongle may be applied by a Merchant with all account types.
  • Merchant can use Card Dongle at other outlets owned by the Merchant, as long as those other outlets are connected through the Multi Outlet feature.


D. How to Obtain a Card Dongle

Merchant can obtain Card Dongle through the Bank branches and/or third parties that collaborate with the Bank and/or other methods and media developed by the Bank in the future.
 

E. How to Use a Card Dongle

  • The Card Dongle can only be connected to the Application using a smartphone and/or tablet with a minimum of Android OS 11.
  • Merchant will receive a device number on the Card Dongle to verify and activate the Card Dongle through the Application.
  • The device number can be entered by typing it directly, uploading a photo of the barcode, or scanning the barcode available on the Card Dongle.
  • Merchants will automatically receive an additional payment acceptance method via Card Dongle in the cashier menu of the Application, after the device has been successfully verified and activated in the Application.
  • At any given time, the Card Dongle can only be connected to one (1) Merchant outlet. Merchant can activate a Card Dongle that has ben connected to a different outlet, which will automatically disconnect it from previous outlet.
 

F. Transaction

  • Payment can be made through the dip or tap Card method on the Card Dongle or other methods that will be developed by the Bank in the future.
  • In the event that payment is made through the dip Card method on the Card Dongle, the Merchant shall direct the Buyer to enter the Card PIN in the Application.
  • If payment is made using the tap method on the Card Dongle with a maximum Transaction of Rp1,000,000 (one million Rupiah), the Buyer does not need to input the Card PIN on the Application. The Card PIN must be inputed by the Buyer through the Application for Transaction above Rp100.00000 (one million Rupiah).
  • Merchants are subject to a Merchant Discount Rate (MDR) on the use of Card Dongle, namely:
    • Bank debit card at 0.15% x Transaction amount.
    • Bank credit card at 1.80% x Transaction amount.
    • Other bank debit cards at 1% x Transaction amount.
    • Other bank credit cards at 1.80% x Transaction amount.

    MDR is subject to change at any time in accordance with Bank policy.

  • In the Transaction acceptance, Merchants are obliged to ensure that the Transaction is made by the Cardholder, with the following conditions:
    • Ensuring the validity period and authenticity of the Card.
    • Ensuring that the Card number indicated on the Card Dongle and/or Sales Draft is in accordance with the Card number contained in the Card.
  • If there is any doubt regarding the acceptance of the Card as referred to in points F.3 and F.5, Merchant may contact the Bank during the Transaction acceptance process or the Merchant may refuse the Transaction based on its own considerations.
  • Merchants are obliged to accept the Transaction made by the Buyer without limitation of minimum payment and provide the best service to Cardholder and/or Buyer.

G. Transaction Cancellation

  • Merchants may request a Transaction cancellation (void) no later than 11:45 p.m. WIB on the same day Transaction was successfully completed.
  • If a Merchant request a Transaction cancellation, the Merchant must select and/or fill in the reason for the Transaction cancellation available on the Application.
  • If the Transaction cancellation request is submitted by a cashier, the cashier must select the owner or manager as the person responsible for confirming the Transaction cancellation request (hereinafter referred to as the “Person Responsible”) either onsite or online on the Application.
  • If the Person Responsible approves the Transaction cancellation request, the Person Responsible will be asked to validate by entering their account PIN on the Application.
  • If the requested Transaction cancellation is successful, the disbursement status on the Transaction report page in the Application will be updated to “Canceled”.
  • If a Transaction is successfully canceled, the funds for that Transaction will be returned to the Buyer’s account.
     

H. Cost

  • Based on the provisions of the regulator and/or provisions of the Bank, for any Transactions or activities of the Merchant for the use of Card Dongle, the Bank is entitled to charge a cost (in rupiah) to Merchant.
  • Bank has the right to at any time change the costs upon the use of a Card Dongle by taking into account the applicable provisions.
  • Merchant understands that each payment method provided by the Bank or related to the third party may be charged with additional costs by the third party beyond the costs determined by the Bank.


I. Card Dongle Transaction Fund Disbursement

  • Merchant with Standard account types have a Card Dongle Transaction fund disbursement limit of Rp 10,000,000.00 (ten million Rupiah) or in accordance with Bank policy.
  • Card Dongle Transaction fund disbursement is carried out on the next Business Day at 6:00 a.m. WIB.
  • If the Merchant is managed by an operator that cooperates with the Bank (“Operator”), then:
    • The Bank will disburse Transaction funds to the Merchant’s Account after deducting MDR fees and fees to the Operator.
    • The Merchant understands that the fees to the Operator refer to the fees registered by the Operator with the Bank, which have been agreed upon by the Merchant and the Operator and are the sole responsibility of the Merchant and the Operator.
    • If there is a discrepancy between the fees disbursed by the Bank and the fees agreed upon by the Merchant and the Operator, it shall resolved directly by the Merchant and the Operator, unless it can be proven to be due to an error on the part of the Bank.
  • If a Standard account type Merchant has Transaction funds that exceed the disbursement limit, the excess funds will be withheld and scheduled for disbursement in the next disbursement in accordance with the Bank’s policy.
  • The Merchant hereby authorizes the Bank to withhold a certain amount of the Merchant’s Transaction funds for a certain period if there are Transactions that are indicated or proven to be fraudulent.
     

J. Prohibited Activities

  • In terms of Transaction acceptance, Merchants are not allowed to:
    • Accept Transactions that are not in accordance with those stipulated in these Terms and Conditions;
    • Performing split Transaction value to avoid violation of Bank's provisions.
    • Accept a Card from a Cardholder that is used to refinance existing debts to replace a bounced check, except under applicable laws.
    • Serving cash withdrawal Transactions with Credit Cards.
    • Impose additional fees in any form to Buyer, those regulated in laws and regulations;
    • Receive Transaction deposits from third parties or other Merchant branches/outlets;
    • Intentionally commit the fault in inputting the nominal price;
    • Merchant runs a business that is not in accordance with the Terms and Conditions; and/or
    • Document and/or record and/or take pictures of Buyer inputting the PIN on Application, including record the number and/or expired date of the Card.
  • The Bank and/or other third party appointed by the Bank have the right to investigate Merchant if there are indications of a violation in the provision of J.1 of these Terms and Conditions.
  • If Merchant is strongly suspected by the Bank to be proved to have violated the provisions of J.1, then:
    • All unauthorized Transactions or those that are not recognized by Cardholder and/or Buyer and/or Card Issuer will be a burden and responsibility of the Merchant.
    • The Bank has the right to suspend the payment of bills amounting to the total nominal amount of the Transaction.
    • The Bank has the right to deactivate the payment method owned by the Merchant.
 

K. Notice for Card Dongle Users

Merchants are advised to exercise caution when using Card Dongles to prevent damage, loss and/or transfer to unauthorized parties
 

L. Representations and Warranties

  • Merchant represents that the Merchant has filled in the data in accordance with the applicable provisions, the fault or omission of Merchant in inputting data on Application shall be the full responsibility of Merchant.
  • All consequences arising in connection with the use and maintenance of a Card Dongle shall be the full responsibility of the Merchant. Merchant is responsible for any damages, losses or expenses directly or indirectly arising upon the omission of Merchant.
  • In the implementation of payment method of Card Dongle, Bank have implemented security standardization as set out in the applicable laws and regulations. Therefore, the Merchant and/or its Employees are personally responsible for maintaining the security and use of a Card Dongle.

M. Miscellaneous

  • Merchant understands and agreesthat the provisions of payment Transaction and Merchant on the Application in these Terms and Conditions is a part of Terms and Condition of Use of the Application,thus, all matters related to Transaction aspects including but not limited to instructions provided by Merchant on Application and/or privacy policy are subject to the funds product provisions in Bank as well as Terms and Conditions of Use of the Application. No provisions in these Terms and Conditions may reduce or limit the validity of representations and warranties provided by Merchant in Terms and Conditions of Use of the Application.
